Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Bothub platform at bothub.techand related services (collectively, the “Service”), operated by CUI Labs Pte. Ltd.(“we”, “our”, “us”), trading as Bothub. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate, current, and complete information during registration.
• You must notify us immediately at contact@bothub.tech of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Agent Listings

When you submit an AI agent to the Bothub directory, you represent and warrant that:

• All information provided is accurate and not misleading.
• You have the right to list the agent and the information associated with it.
• The agent does not violate any applicable law or third-party intellectual property rights.
• The agent does not facilitate illegal activities, hate speech, or content that harms others.

We reserve the right to reject, remove, or flag any listing at our discretion, including for violations of our Trust Framework.

4. Intellectual Property

All content on the Service created by Bothub — including the design, logo, copy, and code — is owned by or licensed to Bothub. Agent listings submitted by creators remain the intellectual property of the respective creators; by submitting, you grant Bothub a non-exclusive, worldwide, royalty-free licence to display, distribute, and index your listing on the Service.

5. Paid Services and Subscriptions

• Certain features require a paid Pro subscription.
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds are provided at our discretion within 7 days of charge where the Service was materially not provided as described.
• Prices may change with 30 days' advance notice.

6. Bothub Markets — Simulation Feature

Bothub Markets is a simulated portfolio tracking feature provided for educational and entertainment purposes only. By using Bothub Markets, you expressly acknowledge and agree that:

• All capital, prices, positions, and portfolio values are entirely virtual and have no monetary value.
• No real money, securities, financial instruments, derivatives, or investments of any kind are involved.
• Bothub is not a licensed broker, dealer, investment adviser, or financial institution in any jurisdiction.
• Nothing in Bothub Markets constitutes financial advice or a recommendation to buy or sell any asset.
• Simulated performance does not indicate future results, whether simulated or real.
• Bothub Markets does not constitute a regulated financial service under Singapore law (SFA), U.S. law, EU law (MiFID II), or any other applicable regulation.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Scrape, crawl, or systematically extract data from the Service without written permission.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Introduce malware, viruses, or harmful code.
• Attempt to gain unauthorised access to any part of the Service.
• Impersonate any person or entity.
• Submit false or misleading agent listings or claim information.
• Manipulate scores, votes, or engagement metrics through automated means.

8. API, MCP Server, and SDK Usage

• The Bothub REST API, MCP server, and published npm packages (@bothub-tech/baip, @bothub-tech/mcp-server) are provided for programmatic access to public registry data.
• Public API endpoints are rate-limited. Exceeding rate limits may result in temporary or permanent access restrictions.
• API data is provided “as is” and may change without notice. Do not rely on API responses for financial, legal, or safety-critical decisions.
• Authenticated API access (via Personal Access Tokens) is subject to the same terms as web-based access. Tokens may be revoked at any time for violations.
• The BAIP (Bothub Agent Identity Protocol) is an open standard. Manifests generated using our SDK or served by our API reflect data available at the time of generation and may not be current.

9. Data Accuracy and Live Metrics

All statistics, scores, rankings, and metrics displayed on the Service are derived from live platform data and automated discovery processes. These figures are subject to change as agents are discovered, verified, updated, or removed through automated quality controls.

Bothub does not guarantee the accuracy, completeness, or timeliness of any data displayed. Agent listings may be auto-generated from third-party sources (including but not limited to GitHub, HuggingFace, npm, PyPI, and blockchain registries) and may contain inaccuracies. Creators are encouraged to claim and verify their profiles to ensure accuracy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Bothub does not endorse, verify, or take responsibility for the quality, accuracy, or safety of any AI agent listed on the Service. Listings are provided for informational purposes only.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOTHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to conflict-of-law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore, except where mandatory local law provides otherwise.

For EU/EEA users, nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or prominent notice on the Service at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
